Should Buyers' Brokers Present Offers Directly to Sellers? |
Here in Northern New Jersey, many of the listings specifically state that "All offers to
be presented to LSP via fax..." If the Seller wasn't home during the showing (which is
generally the case), we don't see the Seller sometimes until the Closing. And that's only maybe. While most agents (at least those that have been in the business a long time) are aware of the "right" to present the offer to the Seller in person, sending the Contract to the Listing Agent by fax or by dropping it off at the office seems to be the accepted way.
However, there are reasons for this:
--The market in this area has been very hot for the past year-plus. Taking time out to set up "appointments" to present your offer has become a problem---especially if you have multiple offers. Many agents call both Sellers at work to tell them what they have. They don't want to come home to negotiate at 9 o'clock at night.
---Multiple offers have made the Listing Agents almost like actioneers, going back and forth with Buyer's agents with counter-offers. While you're waiting for your appointment to present your offer to the Seller, the Seller could take another offer.
---If you should be fortunate to have several listing, with offers on some or all.....well, you get the picture.
---Modern Technology has allowed for this, and human nature, being what it is, forces us to take the easy route. And, because of Modern Technology, there are MORE changes in this business to come. The days of "schmooze and sign" are over.
---Busy Sellers, who say to the Listing Agent, "Which contract has the highest price? That's the one I'll take. I'm being relocated within 30 days..." or "I'm going to Closing on my new house in two weeks..." etc.
I have seen Brokers and Salesperson who are old timers in the business taken aback by the lack of interest of new people to present the offers directly to the Seller (among other amenities of the business), but it is a new business now. More changes to come...!
