Why Attorney David Barry Is Challenging The NAR's Servicemarks |
To Realty Times Staff:
The above title as well your article: NAR Wins Trademark Challenge is misleading.
Also the publicity by NAR is misleading.
NAR OFFICIAL NEWS RELEASE: NAR Wins Freeman Trademark Cancellation Trial.
The United States Trademark Trial and Appeal Board rejected Freeman's cancellation petition, based on the doctrine of licensee estoppel.
The TTAB did not rule on the validity of the Realtor marks.
For your information, a new cancellation petition was also filled with TTAB.
The new petition will seek the cancellation of the Realtor marks on the same generalness ground on behalf of Mr. Jacob Zimmerman
who owns about 2,000 URLs with the name Realtor in them.
He has never been a member of any Realtor association, and thus the doctrine of licensee estoppel does not apply to him.
Sincerely yours,
