The question that may arise in the mind of the consumer is who owns the data in question and I submit that a good number of consumers believe that their personal data actually belongs to them. They may also believe that they have the right to give or deny someone the use of said data, be it on a restricted, unrestricted, exclusive or non-exclusive basis, while reserving the right to deny anyone the use of their personal data without their express consent. If the real estate industry in general can show in a court of law that they hold the sole and exclusive right to the consumers data, based on the consumer's express consent and that said consent was obtained subsequent to the full and timely disclosure of all facts AS MAY BE material to the consumer in relation thereto and that in so doing it was in the the best and sole interest of the consumer, together with the supporting testimony of the consumer ....... they may have a case.
