Legal Ownership of Domain Names

Sorry, duncan1k, there is no question about the ownership of these personal names/domain names. It's unlikely that these domain name registrations, each and every one registered to a real estate company with St. Joe Real Estate Services head computer guy as the admin contact, are mistakes. Identity theft? Could be! Your name and your domain name are your professional identity, aren't they? With St. Joe, you must carefully guard your interests!

Domain name ownership policies vary from registrar to registrar, but the domain names cited in our first post are registered with Network Solutions, formerly known as InterNIC. Their policy is that the REGISTRANT is the legal owner and hence the ultimate authority for a domain name.

It is highly unlikely that the Administrative Contact (Duayne Furgason) for these domain names would make a "mistake" and inadvertently register an agent's personal name/domain name to his employer. A computer professional like Duayne Furgason would know the proper procedure. He also would know that the administrative contact can change any information EXCEPT the registrant (the owner). This policy of Network Solutions comes in to frequent use when a domain name owner changes the host computer for the domain name web site -- the Admin Contact may authorize this transfer.

Lenn Harley's broker sued her to prevent her from taking a domain name with her. If Dana Weldon, for example, changes companies and wants to take her domain name with her, she could find it difficult, if not impossible. Dana Weldon can't take her personal name/domain name with her UNLESS the registrant (St. Joe) allows it. Again, a computer professional like Duayne Furgason would know the proper procedure.

To transfer ownership of a domain name (in this example, danaweldon.com) from St. Joe Real Estate Services, Inc. to Dana Weldon, the REGISTRANT (St. Joe) must notarize a domain name ownership transfer form and send it to Network Solutions. It can be a very complicated transaction even under the best of circumstances. Dana Weldon subsequently pays a new registration fee as the new owner as a result.
