This is an absolutly ridiculous lawsuit. Does this client REALLY believe there is an omnipotent broker out there that affects how their agents do business? To put it bluntly, brokers are there to hold the licenses for those that do the real work, the agents. They are also there to provide (but not always) educational and advertising support. At least ONE agent on this deal lost out on a commission because he was the lower bid, regardless of WHO that agent's broker was. As far as the price of the house, this is not totally uncommon for sought after properties. Many homes will for above list in such instances. I would think someone who could afford to pay one million over list would be well educated in this aspect. These agents are people just like you and I. Quit treating them like sharks.
