While it is true that Sellers cannot always adequately answer questions on the Disclosure, there is not reason to get rid of the whole form. In fact, please don't! As the victim of a fraudalent disclosure, I am glad we have it so we can litigate and undo the purchase. Without it, it would be "he said, she said."
The real issue for many buyers, I think, is making sure there are consumer protection laws covering real estate purchases. Not all families, after buying a home, can afford an attorney. There should also be more generally accepted guidelines for public engineers (inspectors) and termite inspectors.
