What it is is really quite simple. All ya gotta do is look at the price of coffee in Bolivia to know that white grapes simply don't make no better pudding than that stuff they serve over in China. See? Now isn't that clear?
The common law of agency is based upon common sense. It was borne out of man's observation of man's own weaknesses. In essence, it says that we are all--by and large--capability of being tempted by conflicts.
So, in an effort to protect those who have lesser knowledge from the potentially predatory nature of those whom they have hired to represent them--who (supposedly) have superior knowledge--there were SPECIFIC common sense fiduciary duties placed upon the party heretofore in Oklahoma known as the AGENT.
Nothing that has been done in Oklahoma has changed the nature of man. All it has done is (attempted to) remove one of the major sources of accountability that used to exist between the agent and the principal.
The bar which used to be high by default, is now sitting on the ground, allowing even the least ethical and honest practitioner to bend the new standard to their will.
