I concur with Mr. Reifert's post and would venture to say that in this day and age all agents are aware of the common law of agency and the fiduciary obligations involved. The problem in the mind of some...... unscrupulous agents ....is that their fiduciary duties are in direct conflict with their personal economic self-interest and when they weigh one against the other, it is their own self-interest and that of their broker that wins the battle. Their rational is that, in the real estate industry the breach of the fiduciary obligation is commonplace and that agents are seldom held accountable. The successful litigation by Ms McGown on behalf of the plaintiff would send a clear message to the industry, without which they will continue on as usual, blind to anyone and anything that is contrary to their own self-interest.
