Clearly the issue is not so much whether the disclosure questions are accurate or relevent as much as who is competent to answer them. The same applies to homeowner association property transactions. The owner should be disclosing all manner of association business to prospective buyers but usually doesn't have easy access to it or the Board simply isn't handling business.

I disagree with your contention that disclosures should be dumped. The concept needs to be modified so that accurate information is actually exchanged at least several weeks in advance of closing so buyers can make intelligent buying decisions.
