The point of Peter Miller's article was the HomeBuyer Protection Plan and the Television Advertisements used in its promotion, are misleading to consumers.
First - The role of the Appraiser is misrepresented to the Consumer. The Purpose of the Appraisal is to develop an opinion of value of the subject real property for the purpose of making a mortgage loan and HUD -FHA providing Mortgage Loan Insurance. The Purpose of the Appraisal is NOT to ensure the buyer is getting a turk key residence.
Second - The Intended User of the Appraisal Report is the Mortgage Loan Lender and HUD-FHA. There is nothing in the HUD 4150.2 which states the intended user of the Appraisal Report is the borrower. In fact, the HUD 4150.2 specifically states "Appraisals performed for HUD/FHA are not intended to protect the buyer: they protect HUD."
The Appraiser has no responsibility to the Buyer/Borrower. Their relationship is with the Mortgagee and HUD-FHA.
Third - Buyers and Brokers, being mislead by HUD-FHA in the announcement of the HomeBuyer Protection Plan as well as Promotional material, are making erroneous decisions when purchasing a home. Despite the Disclosures Buyers are required to sign, many Buyers and Brokers have the impression the Appraiser is there to assure the residence is trouble and problem free. As Peter Miller accurately points out, the Appraiser's role is provide an Indepentent Opinion of Value for use by the Lender and HUD in underwriting and insuring the loan.
There is an element of personal responsibility on the part of the buyer involved in the purchase of a residence. This responsibility should not be shifted to the appraiser by a television commercial.
