Buyer is not being given back the commission

At least, that would be a clumsy way to do things. The way we work it is to negotiate the offer based on the fee we are contracted to receive from the buyer. So, if our Buyer contract is 3% and the co-op fee is 4%, we put it in writing at the start of the offer process that the fee payable to the buyer agent is 3%.

If the listing agent is a real SOB, then we will not tell them up-front, but will negotiate the deal, and then ask for a 1% reduction in price because we are taking 1% less fee. We rarely do this, but have done occasionally.

The other way round, if I was to get the 4%, then give 1% to the buyer, I would be unnecessarily raising my taxable income by that 1%.
