Ms. Evans,
Thank you for an excellent series. Unfortunately the poor soul whom you interviewed in Part II seemed to have a minimal grasp of the sigificance of the new legislation.
Someone commented: "Personally I don't care what you call me as long as you call me when it's time to be paid. And yes, I still expect to get paid as much as I'm paid now."
Unfortunately, it IS critical what folks call us.
Nationwide there are still enough licensees who are agents so that public perception treats transactional brokers as if they were fiduciaries, and compensates them accordingly. But I don't know how much longer this will last. There's a hell of a lot of folks climbing onto the TB side of the scale - using ladders, ropes, and stools provided by their local legislators.
On top of this, if we adopt the concept of a one-size-fits-all national license, drop the distinction between brokers and salespersons, and drop common law agency, we can make out a good case - make that a really, really good case - for NO license. No reason why a guy selling Deere tractors in Tulsa can't sell a condo in San Francisco. I, of course, would be unable to sell tractors in Tulsa - for lack of a license to do so!
The basic problem with the Road Warrior approach to licensing is that we create a s---load of Road Warriors.
