Though the writer raised concerns about Transaction Brokerage, the circumstances also relate to pitfalls involved with Dual Agency and *especially* to Designated Agency.
The judge's decision provides strong evidence that NAR's founding fathers were right, as far back as 1913, when they wrote these words in the Preamble to the NAR Code of Ethics: "REALTORS URGE EXCLUSIVE REPRESENTATION OF CLIENTS."
With NAR's strong push to have Designated Agency implemented into state statutes; i.e., Michigan, this case provides another good example of why "divided loyalty" does not work.
