Tips on Closing a Property in South Florida

 

Florida is a state that does not require attorneys to close a transaction.   A closing may be handled by a title company or an attorney.  While I have used both through the years, and have had good experiences with both, this article is just my opinion. It is a Realtor's®opinion from a Realtor's® perspective on why I think you should always have an attorney when buying or selling a home in Boca Raton, FL  Boynton Beach or South Florida.  You can discuss this with your buyer's agent.

 

ISSUES THAT MAY ARISE PRIOR TO CLOSING

 

A number of issues can come up prior to closing that must be taken care of to obtain clear title to a property.  Municipal lien searches, lien searches and permit searches are done. Code violations, open or expired permits, or liens may have been placed on a property.  These must be cleared up before we go to closing (or settlement as it's known in other states.)

 

Another potential problem that could arise are issues with title.  These are often much more complicated issues than clearing up open permits or code violations.  Oftentimes, people have second homes in Florida and will use attorneys in their home state to draw up documents.  This ultimately leads to problems, as things are titled differently in Florida than other states.  Sometimes people get lucky and the attorney is licensed both in their home state and Florida. 

 

If the person is deceased and there are issues with title, the problem can become more complicated.  You can just imagine.  Even with new construction, it is still a good idea to use an attorney.  

 

CAN HOLD UP CLOSING

 

Many things can hold up a closing, but when you are faced with title issues, this can hold up your closing until clear title is obtained.  It may necessitate hiring an attorney to clear the issues up.

 

Whether you are spending $ 50,000 or $ 5,000,000, buying a house (or condo, villa or townhouse - no matter) this will likely be one of the largest purchases you will ever make.  I always recommend to my clients to hire an attorney, not necessarily to walk them to closing, but to go over all the paperwork.  Buying a home is not the time to be "penny wise and dollar foolish," as the old saying goes.
